"The court is only trying to desensitize outrage over this scandalous verdict. The boy's father, Hussein, said he had no faith in the Israeli justice system, which he said was controlled by the settlers.
"Just imagine how the court would have dealt with the perpetrator had he been Arab and the victim had he been Jewish."
The father said he would turn to the International Criminal Court in The Hague in order to receive justice because it is just impossible for an Arab victim of Jewish terror to get justice in Israel.
"This crime cannot wait in court for a year and a half and two days before resulting in an opinion that he's insane. Where was he a year ago? I'm afraid the court will acquit him. As your Ecclesiastes says, 'all is vanity'. I am afraid of more Ben-Davids appearing if the court doesn't deter them. I want their houses to be demolished,” Yedeot Ahronot quoted Hussein Khdeir as saying.
Khdeir was also quoted as saying "It's very difficult for me to go to the courthouse," he said. "Every time we see my son's murderers, my blood boils. Israeli jails provide good conditions for serious offenders as well. The person who murdered Yitzhak Rabin is in a hotel. The government even allowed him to get married. Is that true punishment?"
Ben David and two others co-murderers reportedly confessed to having beaten Abu Khdeir unconscious and then burning him to death using some kind of flammable material poured on the teen while he was alive.
According to the charges sheet, as published by Yedeot Ahronot, the group arrived in the Jerusalem Forest, where one of the minors got angry at Ben-David as they were doing most of the work. As a result, the adult took a crowbar and pounded Abu Khdeir while shouting, "this is for the Fogel family" and "this is for Shalhevet Pas" until blood ran down from his head.
The murderers destroyed the evidence in Sacher Park in Jerusalem, and then went to Ben David's in the West Bank settlement of Adam, played guitar and went to sleep.
Israel has a long history of treating Jewish murderers of Palestinians and non-Jews in general extremely leniently.
In 1956, Israeli troops murdered dozens of Palestinian olive harvesters at the village of Kufr Qassem just across the Green line.

“The court is not honest; they are sympathetic to the criminals," said Hussein Abu Khdeir, Mohammed's father. “Every time I go into court I see the one who burned my son and my own heart is burned.”
“I and his mother do not sleep at night; we are taking pills. We think of Mohammed all the time and how he was burned and at the end his murderer is let free for alleged insanity,” he added.
The civilian court in Jerusalem on Monday delayed the conviction of the 31-year-old Yosef Haim Ben David, who murdered Mohammed by burning him alive, until December 20, ahead of assessing a mental health report that was submitted by his lawyer.

The 31-year-old suspect's lawyer submitted an evaluation last week declaring that “he was not responsible for his actions at the time of the murder.”
However, two Israeli boys aged 14 were found guilty in the crime.
During the investigation, David admitted that he took Abu Khudeir to a forest on the outskirts of occupied Jerusalem and hit the boy with a crowbar before setting fire to him and then fled the scene.

The District court judges scheduled a court session on 30/11/2015 for the killer of Martyr Mohammad Hussein Abu Khdeir.
A court session was held on Thursday 22/10/2015 for the Martyr’s killers. The public prosecutor who represents the Martyr’s family and the defense lawyers of the defendants submitted the summaries of the case of the Martyr Mohammad Abu Khdeir. After the next session, the court’s commission should either convict the suspects or acquit them. The prosecutor requested to convict the defendants with premeditated murder. The prosecutor confirmed in his summary that the defendants confessed to burning Abu Khdeir while he was still alive after torturing him. |
The main suspect, Yousef Ben David, was the leader in the killing crime with the help of two minors. He drove the vehicle after kidnapping the child Abu Khdeir from in front of his house in Shu’fat to the area of “Der Yassin” in West Jerusalem. He hit him on his head with a sharp tool and kicked him before pouring gasoline on him and burning him with the help of the other two minors while the victim was still alive.
He added that the defendants represented the crime days after the committed it and despite trying to change their confessions, they were unable to absolutely deny the charges; they attempted to play with their confessions.

22-year-old Abdul Kareem Youssef Abu Khdheir afternoon Saturday sustained wounds and bruises after he was attacked by a horde of Israeli settlers near the illegal settlement of Reches Shu’fat, in Occupied Jerusalem.
“I sustained injuries in my left hand and was rushed to the Hadassah hospital in al-Issawiya after a gang of over 20 Israeli settlers, in their 20’s of age, suddenly attacked me with stones and smashed my car windshield while I was driving near the Reches Shu’fat settlement,” the victim said.
His father said none of the Israeli assailants were arrested by the Israeli occupation police, who were at the scene and remained mum over the attack.
An altercation and fistfight flared up between a group of Palestinian unarmed protesters and the Israeli vandals following the assault.
The father spoke out against the increasing settler attacks against Palestinians in Shu’fat and Beit Hanina following the murder of the Palestinian minor Mohammed Abu Khdheir.

The Palestine Liberation Organization (PLO), on Thursday, issued a special report to be presented to the Arab Foreign Minister’s meeting. The report highlights Israel’s terror attacks by settlers in the occupied West Bank, including occupied East Jerusalem.
Since 2004, Israeli settlers have carried out more than 11,000 attacks against Palestinians in the occupied West Bank.
The settlers attack our people, homes, churches, mosques, trees and even poison our water. Not a single settler is currently imprisoned for the commission of such dreadful crimes, report said.
The report covers the period between January 01st – July 31st, 2015, including the burning and killing of Ali Dawabsha.
The report also provides details for the arson attack.
On the morning of July 31st, 2015, a group of settler criminals attacked and burnt down two Palestinian homes in Duma village in Nablus district. The family of Ma’moon Dawabsheh was not inside at the time its home was attacked, but the home of Ali Saed Dawabsha was burnt while the family was asleep inside.
As a result, baby Ali lost his life. Ali’s mother and father, Riham and Saad, and his four-year-old brother Ahmad suffered severe burns and remain in critical condition as a result of the same attack. The incident harkens back to July of last year when a 16 year old Palestinian child from Jerusalem, Muhammad Abu Khdeir, was kidnapped and burned alive by Israeli settlers.
It also mentions that only a few hours before the attack on Duma, the Israeli Channel 2 broadcast a report about a Jewish terrorist cell based in the occupied West Bank which had attacked the Church of Loaves and Fishes in Tiberias.The TV report revealed information about a compact disc found in the possession of the attackers:
The CD provided instructions for an “easy way to burn Arabs alive”; “First, break the glass windows using stones. Then continuously start throwing molotov cocktails. Then set tires on fire and place them on the exit points of the house, so no one escapes – so all are burnt alive”. This report was broadcast at primetime on a major Israeli TV network. This was a similar method used by the attackers when, hours later, they threw incendiary devices through the glass window of baby Ali’s room and throughout the house.
According to a recent report by Israeli Human rights organization Yesh Din, 85.3 percent of investigative files are closed due the failure of Israeli police investigators to locate suspects or to find sufficient evidence to enable indictment. In addition, only 7.4 percent of investigations have yielded indictments against suspects.
Only one-third (32.7 percent) of legal proceedings have ended in the full or partial conviction of the defendants. This means that the chance that a complaint submitted to the Israel police by a Palestinian will lead to an effective investigation, the location of a suspect, prosecution, and ultimate conviction is just 1.9 percent.
Israeli occupation authorities have established, and continue to consolidate, the illegal settlements and presence of settlers in the occupied West Bank. The Israeli government fuels the crimes of the settlers through hateful rhetoric and incitement against Palestinians. Israeli ministers have publicly called for the killing and dehumanization of the Palestinian people, and the Israeli legal and judicial system provides no legal recourse for victims of the horrific crime that results.
The report added that the State of Palestine holds the Israeli occupation’s government fully responsible for the daily terror attacks it carries out against the land and people of Palestine.

The District Court in Jerusalem postponed the trail of the murderers of Mohammad Abu Khdeir on (15 – 07 – 2015) until 22 – 10 – 2015.
The decision to postpone came to be until the hearing of the psychiatrist in charge of the third suspect named “Itmar Zimir” from “Bet Shemesh” in the case “Kidnapping, Burning and killing Abu Khdeir”, and in the coming session oral summaries from the defense and public prosecution will be presented in regards to the case.
The court attempted to hold a “closed session” for the three settlers accused of murdering Abu Khdeir, under the pretext that the session is specialized to hear the minor suspect “Itmar Zimir” and forced the people present to leave the hall, and when his father and mother arrived at Court they strongly objected to be taken out.

The martyrs’ father accused the courts committee of trying “to fabricate and draft an agreement behind closed doors to exonerate the murderers the settlers or to mitigate their sentences, denouncing stopping them from attending the session of the murderers of their child Mohammad, and he described it as racism and stressing that he is going to go to the International Criminal Court to prosecute the settlers.
Both (the martyrs father and mother) don’t expect justice from the court, it is postponing and procrastinating condemning the settlers and trialing them even thought one year has passed on the crime the case is at a standstill.
After the martyrs family waited for about half an hour and after the Lawyer Muhannad Jbara -the family’s’ lawyer – intervened the court allowed them entry while stopping the journalists from entering under the pretext that “the suspect is a minor”.

The settler Itmar was interrogated by his lawyer and the second settler ” Yaer Ben David’s” lawyer, and from the public prosecutor; the suspect denied through the session his initial confessions that he gave to the police and intelligence, he said that they planned to execute a kidnapping operation and beat up an Arab only and he was shocked when the boy was burnt and murdered.
He said: “we planned to kidnap and Arab and beat him and tie him to a tree in the forest, we used a car that belongs to “Yousef Ben David” wife to conduct this, the cars size is big and we removed booster seat in order to be capable of executing the “kidnapping”, the petrol that we bought was set fires in shops or vehicles or Arab houses as a retaliation to the killing of the settlers in Hebron”
During his interrogation he talked about hitting and tying the child Mohammad Abu Khdeir while detained inside the car, but he denied participating in burning him, (contradicting his initial confessions).
During the session the suspect claimed that he suffered from family problems before executing the operation and participating in the kidnapping and murdering of the child Abu Khdeir, he said: due to a problem with my father I went to my uncle “Yousef Ben David”, and I became very close to him; one day he showed me a film for the funeral of the settlers that were killed in Hebron and decided to kidnap and Arab as a retaliation to that”.
And during the session – A teacher of the suspect Itmar – said that Itmar suffers from severe psychological conditions and takes 3 types of medication, he had advised his parents to take him to a Psychiatrist.
The public prosecutor.. “Itmar” confessed to all the charges
The public prosecutor – whom represents the family – showed a recording to the settlers in a medical eyeglasses shop owned by “Yousef Ben David” that showed them training to execute the kidnapping and assault operation.
The public prosecutor stressed that “Itmar” confessed the charges aginst him and confessed to planning to execute an operation that involved “kidnapping and killing an Arab”.
Judges object to questions from the prosecutor to the suspect!!
The judges objected to some questions asked by the public prosecutor and directed to the suspect “Itmar”, the asked him in some cases to withdraw his questions, the Family saw in this “sympathy with one of the murderers and an attempt to reduce his sentence or acquit him of the crime”.

Israeli soldiers last Thursday targeted journalists working for Jordan's Ro'ya TV with teargas while they were covering a peaceful Palestinian demonstration near Jaba, a village north of Jerusalem.
According to WAFA correspondence, the demonstration was held to mark the first anniversary of the death of Muhammad Abu Khdeir, a 16-year-old Palestinian who was burnt to death in a wood near West Jerusalem.
Ro'ya TV posted a video online showing Palestinian Territories bureau chief Nebal Farsakh and cameraman Mohamed Shousha being targeted although they were wearing bulletproof vests marked 'Press.' They were taken to a hospital with facial burns.
Alexandra El Khazen, the head of the Reporters without Borders Middle East and Maghreb desk said, “The Israeli security forces must respect the physical integrity of journalists who are just doing their job by covering demonstrations.”
“We remind them that the UN Human Rights Council adopted a resolution in March 2014 recognizing that journalists play an essential role by covering protests.”
The incident was not the first time Israeli forces target journalists in recent months. On May 17, Israeli police used force to prevent a crew with Russian TV station RT from filming during Jerusalem Day, which commemorates Israel's conquest of East Jerusalem and the Old City during the 1967 War.
Although they had accreditation, RT reporter Dalia Nammari and cameraman Muhammad Aishuwere were manhandled and their camera was broken. They have filed a complaint.
Nidal Ashtiyeh, a Palestinian photojournalist working for the Chinese news agency Xinhua, was covering a Palestinian demonstration near Nablus on May 15 marking the 67th anniversary of the Nakba when he was badly injured in an eye by a rubber-coated bullet fired by an Israeli soldier. He has not yet recovered his sight in the eye and needs to receive special treatment.
The Israel army also stopped a peaceful demonstration by the Palestinian Journalists' Syndicate in the West Bank city of Bethlehem on May 2 (the eve of World Press Freedom Day). The demonstrators had planned to march from the edge of the city to an army checkpoint but were stopped by teargas and flash grenades.
B’Tselem, an Israeli human rights group, says, “This type of abusive behavior has gradually become a part of everyday reality for Palestinians of the occupied territories. On occasion there are also cases of more serious violence, which Israeli authorities condemn but often do not take real measures against the perpetrators.”
“Most cases involve a 'small dose' of ill-treatment such as a slap, a kick, an insult, a pointless delay at checkpoints, or degrading treatment. These acts have become an integral part of Palestinian life in the Occupied Territories. From time to time, however, cases of severe brutality occur.”
